Welcome to Chamber Pros Community and the Ambassador Activity Tracker.

These Legal Agreements, Privacy Policy, and Terms of Service apply to your use of our websites, online resources, digital products, membership areas, training resources, software tools, and the Ambassador Activity Tracker application, collectively referred to as the “Services.”
The Services are owned and operated by Frank J. Kenny, LLC. Throughout this document, the terms “Company,” “we,” “us,” and “our” refer to Frank J. Kenny, LLC, Chamber Pros Community, and related products, services, websites, and applications. The terms “you,” “user,” “customer,” “chamber,” “administrator,” “ambassador,” or “volunteer” refer to the person or organization accessing or using the Services.
By accessing or using our website, app, products, services, membership areas, digital resources, or related materials, you agree to be bound by these terms. If you do not agree with these terms, please do not use the Services.

1. Use of the Services
The content, training, tools, software, templates, resources, and information we provide are intended for general business, chamber of commerce, marketing, education, operations, volunteer engagement, and professional development purposes.
We make reasonable efforts to provide useful and accurate information. However, we do not guarantee that all information, materials, app features, reports, training resources, examples, templates, or tools will be accurate, complete, current, uninterrupted, or suitable for your specific situation.
Your use of the Services is at your own risk. It is your responsibility to decide whether our products, services, tools, training, software, or resources are appropriate for your organization, staff, volunteers, members, or community.
We may update, change, remove, replace, suspend, or discontinue any part of the Services at any time. This may include changes to website content, app features, training resources, templates, digital products, membership benefits, software functionality, pricing, or access.

2. Ambassador Activity Tracker
The Ambassador Activity Tracker is designed to help chambers of commerce and similar organizations track ambassador activity, encourage volunteer engagement, document participation, and recognize contributions.
The app may include user accounts, rosters, activity logs, points, leaderboards, uploaded photos, notes, reports, user roles, administrator tools, and related features.
The app is intended to support chamber operations and volunteer engagement. It is not intended to serve as a legal, financial, payroll, tax, employment, or official recordkeeping system.
Each chamber is responsible for deciding how it uses the app, how it defines ambassador activities, how it assigns points, how it verifies submissions, how it recognizes volunteers, and how it manages its ambassador program.
Frank J. Kenny, LLC is not responsible for disputes between a chamber and its ambassadors, volunteers, staff members, board members, sponsors, members, or other participants.

3. Authorized Access and User Roles
Access to the Ambassador Activity Tracker is limited to authorized users. Authorized users may include chamber staff, chamber administrators, ambassadors, volunteers, board members, committee members, or other individuals approved by the chamber or organization using the app.
You agree not to access, or attempt to access, any chamber portal, account, data, roster, activity log, uploaded image, report, leaderboard, or other information unless you have been authorized to do so.
The app may include different levels of access for administrators, staff users, ambassadors, volunteers, and super administrators. Chamber administrators are responsible for deciding who should have access to their chamber’s portal.
Chamber administrators are also responsible for removing users who should no longer have access. This may include former employees, former volunteers, inactive ambassadors, former board members, former committee members, or others no longer affiliated with the chamber.
Frank J. Kenny, LLC may provide technical support and may assist with account setup, troubleshooting, maintenance, or system administration. However, each chamber remains responsible for managing its own users, internal policies, volunteer expectations, activity rules, and recognition program.

4. Magic Link Login and Account Security
The Ambassador Activity Tracker may use Magic Link authentication or similar passwordless login technology. This allows users to access the app through a secure link sent to their email address.
You are responsible for maintaining the security of your email account. If someone gains access to your email account, that person may be able to access your Magic Link and enter your account.
You agree not to forward Magic Links, share login access, or allow unauthorized users to access the app through your email account. Frank J. Kenny, LLC is not responsible for unauthorized access that results from a compromised email account, forwarded Magic Link, shared device, weak email security, or failure to protect your own access.
If you believe your account or email has been compromised, you should notify your chamber administrator and contact us as soon as possible.

5. Points, Leaderboards, and Recognition
The points, rankings, badges, leaderboard standings, activity totals, and related features within the Ambassador Activity Tracker are intended for engagement, motivation, tracking, reporting, and recognition purposes only.
Points, badges, rankings, leaderboard placement, and activity totals have no cash value through Frank J. Kenny, LLC. They do not represent wages, compensation, commissions, employment benefits, gift cards, prizes, or any other form of payment from Frank J. Kenny, LLC.
A chamber may choose, on its own, to recognize ambassadors, provide incentives, offer prizes, or create its own reward structure. If a chamber chooses to do so, that chamber is solely responsible for setting the rules, communicating the terms, verifying eligibility, handling tax or employment questions, and resolving disputes.
Frank J. Kenny, LLC is not responsible for the accuracy of points awarded, the fairness of activity rules, the value of rewards, the administration of prizes, or any dispute related to recognition, incentives, volunteer status, employee status, compensation, or participation in a chamber ambassador program.

6. No Employment Relationship
Use of the Ambassador Activity Tracker does not create an employment, contractor, agency, partnership, joint venture, fiduciary, or compensation relationship between Frank J. Kenny, LLC and any ambassador, volunteer, chamber employee, chamber representative, or app user.
The app is a software tool used by chambers and similar organizations. Frank J. Kenny, LLC does not supervise chamber ambassadors, direct volunteer work, control chamber staff, assign chamber duties, verify volunteer hours for employment purposes, or determine whether any person is an employee, volunteer, contractor, or representative of a chamber.
Each chamber is responsible for complying with applicable employment, labor, wage, hour, volunteer, tax, and nonprofit rules related to its own staff, volunteers, ambassadors, board members, and participants.
If a chamber has questions about volunteer status, employee classification, compensation, incentives, or labor law compliance, it should consult its own attorney or qualified professional advisor.

7. Activity Logs and Data Accuracy
Users may submit activity entries, descriptions, dates, notes, comments, photos, or other proof of activity through the app.
Frank J. Kenny, LLC does not guarantee the accuracy, completeness, fairness, or reliability of any activity entry, point total, report, ranking, leaderboard, uploaded photo, or user-submitted content.
Chamber administrators are responsible for reviewing, approving, editing, correcting, rejecting, or removing activity entries when needed.
Any reliance on activity logs, points, leaderboards, reports, uploaded photos, or app data for legal, financial, employment, tax, compensation, insurance, grant, contractual, or official recordkeeping purposes is strictly at your own risk.
Chambers are encouraged to maintain their own official records and backups for any information they consider important for formal business, legal, financial, or operational purposes.

8. User Content
Users may be able to upload photos, notes, comments, descriptions, or other content through the app. This content may be used as proof of activity, documentation of participation, or support for ambassador recognition.
By uploading content, you represent that you have the right to upload and share that content. You also represent that the content does not violate another person’s privacy, publicity rights, intellectual property rights, workplace rights, chamber policies, event rules, or applicable law.
You agree not to upload content that is unlawful, offensive, harassing, discriminatory, defamatory, misleading, confidential, private, inappropriate, or unrelated to the intended use of the app.
You are solely responsible for the content you upload.
By uploading content, you grant Frank J. Kenny, LLC a limited, non-exclusive, royalty-free license to host, store, display, transmit, process, and use that content as needed to operate, maintain, support, secure, and improve the Services.
This license is limited to the operation and support of the Services. It does not mean that Frank J. Kenny, LLC owns your uploaded content.
We reserve the right, but are not obligated, to remove any content that we believe is inappropriate, unauthorized, unlawful, misleading, offensive, or inconsistent with the intended use of the app.

9. Photos and Permission
Users should not upload photos of individuals unless they have permission or a reasonable basis to believe the photo may be shared within the chamber’s app portal.
Chambers are responsible for setting and communicating their own policies related to event photography, volunteer participation, member photos, public events, private events, consent, and use of images.
Frank J. Kenny, LLC is not responsible for obtaining photo releases, verifying consent, or resolving disputes related to photos uploaded by chamber users, ambassadors, volunteers, staff members, or administrators.

10. Privacy Policy
Chamber Pros Community and Frank J. Kenny, LLC are committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, share, and protect information provided through our websites, apps, forms, purchases, memberships, digital products, software tools, and related Services.
We may collect information you voluntarily provide to us, including your name, job title, chamber or company name, mailing address, email address, phone number, billing information, professional role, preferences, interests, survey responses, product purchases, course activity, membership activity, website activity, customer support communications, and other information you choose to provide.
When you use the Ambassador Activity Tracker, we may collect and store information related to your chamber, your role, your account access, and your activity within the app. This may include your chamber affiliation, company or organization name, volunteer role or committee, user role within the app, email address used for login, and phone number if provided.
The app may also collect information related to ambassador activity, including activity dates, activity types, activity descriptions, points earned, leaderboard placement, uploaded photos, notes or comments submitted as proof of activity, and administrative edits or approvals made by authorized chamber users.
We may also collect limited technical and support-related information, including Magic Link authentication records, login records, customer support records, device or browser information, and system usage information. This information helps us maintain account security, troubleshoot issues, provide support, improve the app, and protect against unauthorized access or misuse.

11. Collaborative Data Visibility Within the App
The Ambassador Activity Tracker is a collaborative chamber management and engagement tool. It is not a private personal journal.
Information entered into the app may be visible to other authorized users within the same chamber portal, depending on user role, app settings, and chamber practices.
Within your specific chamber portal, certain information may be visible to authenticated chamber users, including administrators, staff, ambassadors, approved volunteers, or other authorized participants. This may include your name, company or organization, email address, phone number if provided, volunteer role, activity submissions, points, leaderboard ranking, photos, and notes submitted as proof of activity.
This visibility is intended to support chamber networking, committee coordination, volunteer engagement, accountability, reporting, and recognition.
By using the app, you understand and agree that information you submit may be seen by other authorized users within your chamber portal.

12. Chamber Data Separation
Each chamber portal is intended to be separate from other chamber portals.
Users from one chamber should not be able to view the roster, contact details, activity logs, photos, leaderboards, reports, or other data belonging to another chamber.
We use technical access controls intended to limit access to authorized users within each chamber portal. These may include user roles, permission settings, authentication tools, row-level security, or similar safeguards.
However, no internet-based system can be guaranteed to be completely secure or error-free.
If you believe you have accessed information that does not belong to you or your chamber, you agree to stop viewing it immediately and notify us.

13. Administrative Access by Frank J. Kenny, LLC
Frank J. Kenny, LLC staff, contractors, support providers, developers, or technical administrators may access app data when needed for customer support, troubleshooting, security, maintenance, system administration, product improvement, billing, account management, or legal compliance.
These administrative users may have technical access to chamber data but may not appear in the chamber’s internal roster or leaderboard.
We will use reasonable efforts to limit administrative access to legitimate business, technical, support, security, or operational purposes.

14. How We Use Information
We may use the information we collect to provide the Services, manage accounts, authenticate users, process payments, provide customer support, improve our products, send service-related messages, send product updates, deliver training, customize your experience, analyze website and app activity, maintain internal records, protect against misuse or unauthorized access, enforce our terms, and comply with legal obligations.
We may also use your information to send educational emails, newsletters, product updates, offers, event announcements, training invitations, or other information we believe may be useful to chamber professionals and business users.
You may opt out of marketing emails by using the unsubscribe link in our emails or by contacting us. Even if you opt out of marketing emails, we may still send transactional, administrative, billing, security, account, or service-related messages.

15. Cookies, Analytics, and Affiliate Tracking

For the Ambassador Activity Tracker, we may use Magic Link authentication, user roles, access controls, row-level security, hosting protections, database permissions, and similar safeguards.
However, no website, app, database, email system, hosting service, or internet-based service can be guaranteed to be completely secure.
You are responsible for keeping your email account secure and for not forwarding login links to unauthorized users.

18. Data Retention
We may retain personal information, account records, purchase history, app data, activity logs, uploaded content, customer support records, and related information as long as reasonably necessary to provide the Services, maintain business records, comply with legal obligations, resolve disputes, improve products, provide support, enforce agreements, or protect the security and integrity of our systems.
Chambers may request deletion or correction of certain data, subject to technical, legal, contractual, backup, security, and business recordkeeping limitations.
Some information may be retained when needed for legal, tax, accounting, billing, fraud prevention, security, dispute resolution, contractual, backup, or legitimate business purposes.

19. No Sale of Personal Information
We do not sell, distribute, or lease your personal information to third parties for their independent marketing purposes.
We may share information with service providers who help us operate our business, website, app, payment systems, email systems, customer support, hosting, analytics, or related services.
We may also disclose information when required by law, legal process, court order, government request, security investigation, enforcement of our terms, protection of our rights, or protection of the rights and safety of others.

20. Links to Other Websites
Our website, app, emails, products, or resources may contain links to other websites.
Once you leave our website or app, we do not control the other website. We are not responsible for the protection, privacy, security, accuracy, availability, or content of third-party websites.

They are not intended for children under the age of 13.
We do not knowingly collect personal information from children under 13.

You may not attempt to access another chamber’s data, interfere with the security or operation of the Services, upload malicious code, misuse Magic Links, share access with unauthorized users, copy or scrape app data without permission, upload inappropriate content, violate another person’s rights, or use the Services in a way that could damage Frank J. Kenny, LLC, Chamber Pros Community, another chamber, another user, or any third party.
We may suspend or terminate access if we believe a user has violated these terms, misused the Services, created a security risk, failed to pay required fees, submitted a chargeback, or acted in a way that may harm the Services or other users.

23. Intellectual Property
The website, app, software structure, design, layout, look, appearance, graphics, text, tools, training materials, templates, resources, videos, documents, branding, logos, product names, and related materials are owned by or licensed to Frank J. Kenny, LLC unless otherwise stated.
You may not reproduce, distribute, modify, republish, resell, sublicense, copy, scrape, exploit, or create derivative works from our materials without written permission, except as expressly allowed through your purchase, subscription, membership, app license, or written agreement.
All trademarks, logos, and brand names not owned by us are acknowledged as the property of their respective owners.

24. Payments, Subscriptions, and Access
Some products, services, memberships, app features, subscriptions, or licenses may require payment.
By purchasing a product, subscription, membership, app license, or service, you agree to pay the stated fees and any applicable taxes.
Unless otherwise stated at purchase, subscriptions may renew automatically until canceled.

We may provide training, tools, software, templates, examples, ideas, strategies, recommendations, and resources intended to help chambers and businesses improve operations, marketing, engagement, retention, revenue, volunteer participation, member communication, or organizational effectiveness.
However, we do not guarantee any specific result.
Your results may vary based on your chamber, market, staff capacity, member base, board support, volunteer participation, implementation, leadership, communication, local economy, available resources, and other factors outside our control.

The information provided through our website, app, training, resources, templates, videos, communications, and related Services is for general informational and educational purposes only.
It is not legal, tax, accounting, financial, employment, insurance, or professional advice.
You should consult your own qualified attorney, CPA, insurance advisor, HR professional, or other professional advisor for advice specific to your organization or situation.
We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, availability, security, or performance of the Services, information, app data, reports, graphics, tools, or related materials.
Any reliance you place on the Services or any information provided through them is strictly at your own risk.

27. Technical Availability and Data Loss
We make reasonable efforts to keep the Services available and operating properly.
However, we do not guarantee uninterrupted access, error-free operation, specific uptime, permanent storage, or continued availability of any particular feature, report, data, image, or function.
We are not responsible for temporary service interruptions, maintenance, hosting problems, internet outages, third-party service failures, security events, software bugs, data loss, lost activity records, lost photos, lost points, lost reports, lost rankings, or other issues beyond our reasonable control.
Chambers are encouraged to periodically export, save, screenshot, or otherwise back up any app information they consider important for their own operational, historical, financial, legal, or recordkeeping purposes.

28. Limitation of Liability
To the fullest extent permitted by law, Frank J. Kenny, LLC, Chamber Pros Community, and their owners, employees, contractors, affiliates, service providers, and representatives will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or related to your use of, or inability to use, the Services.
This includes, without limitation, damages related to loss of data, loss of profits, loss of revenue, business interruption, volunteer disputes, employment claims, reputational harm, inaccurate points, incorrect leaderboard results, unauthorized content, privacy disputes, app downtime, technical errors, third-party services, or reliance on activity records.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services shall not exceed the amount paid by you to Frank J. Kenny, LLC for the applicable Service during the twelve months before the claim arose.
Some jurisdictions may not allow certain limitations of liability, so some of these limitations may not apply to you.

29. Indemnification
You agree to indemnify, defend, and hold harmless Frank J. Kenny, LLC, Chamber Pros Community, and their owners, employees, contractors, affiliates, service providers, and representatives from and against any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorney’s fees, arising out of or related to your use or misuse of the Services.
This includes claims related to your violation of these terms, unauthorized access, uploaded content, privacy violations, intellectual property violations, disputes between a chamber and its users, disputes regarding points or rewards, employment or volunteer classification issues, or failure to comply with applicable laws or internal chamber policies.

We may recommend third-party products, services, tools, platforms, software, books, events, or other resources.
Some of these recommendations may include affiliate links. If you purchase through one of our affiliate links, we may earn a commission at no additional cost to you.
In some cases, we may be able to negotiate special pricing, bonuses, or added benefits for our audience.
We only recommend products or services we believe may be useful. However, you are responsible for determining whether any recommended product or service is appropriate for your needs.

We are not responsible for any loss that results from suspension or termination based on violation of these terms.

We may update these Legal Agreements, Privacy Policy, and Terms of Service from time to time.
When we update these terms, we may post the revised version on our website or within the app and update the effective date.
Your continued use of the Services after changes are posted means you accept the updated terms.
You should review this page periodically to stay informed of any changes.

33. Governing Law and Venue
These terms and any dispute arising out of or related to the Services shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
To the extent a legal action is permitted and is not required to be handled in another location by applicable law, the parties agree that the state or federal courts serving Texas shall be the appropriate venue for disputes arising out of or related to these terms or the Services.
Before filing any legal action, you agree to first contact us and make a good-faith effort to resolve the dispute informally.
